I listened to the oral arguments live and I was flabbergasted by KBJ’s commentary which closely aligned with the ACLU attorney’s.
Don’t get cocky. While I think the government clearly had the better case, conservative justices were doing all they could to figure out how to punt. Not so, Alito and Thomas.
