Supreme Court Justice Stephen Breyer to retire, giving Biden a chance to nominate a replacement

Breyer says he will retire at the end of the current term. I believe that makes his retirement effective September 30, 2022. Democrats have a very slim majority in the Senate as evidenced by the failure of Biden’s BBB effort, and his attempts to eliminate the filibuster. If Biden nominates a kooky far left person for the highest court, the nominee may fail. If that happens there may not be time for a second nominee before the slate of newly elected senators are seated. There is a high probability the Republicans take control of the senate on November 8, 2022 with newly elected senators being seated at the start of the 118th congress on or about January 3, 2023.
