“people had stuck their fingers in diners’ meals, spit in their food and defecated next to tables. The structures were a way for the restaurant to control the dining environment.”

Think about that.

You have invested money to start a fine dining restaurant, but the area is inundated by the smells, droppings, and intimidating physical presence of homeless people that the local authorities refuse to police. You try to find a solution in the form of plastic domes, to isolate patrons from the environmental effects of the homeless, but the local government inspectors close down your restaurant claiming your solution does not meet code. You have to modify your solution so that it is no longer effective in its original purpose before the government inspector will allow you to reopen.
