Since when is the Supreme Court in the business of going beyond constitutionality to mind-reading as to why bureaucrats devise policies that are constitutional?

This was my impression the moment I heard of the decision and that the Chief Justice was the tie-breaker. I am inclined to think the Chief Justice may be infected with TDS.
